Acceptance
By using the Orbily application or this website you agree to these Terms of Service. If you do not agree, do not use the service.
These terms may be translated into other languages for convenience. In case of any inconsistency, the English version published on this site prevails.
The service
Orbily turns your lessons and documents into study material: imported chapters, generated courses, flashcards, quizzes, graded corrections, a study timer and the Orby assistant. It works on iOS and Android and complements this website.
Features evolve. We may add, change or remove functionality, provided your already created content remains accessible or exportable whenever technically possible.
Account
You need an account with a valid email address. Keep your password confidential; you are responsible for activity under your account.
You may delete your account at any time from the app settings. Deleting the account also deletes the server-side data attached to it.
Purchases and subscriptions
Paid subscriptions are offered inside the app through the Apple App Store and are governed by our Subscription Terms (Terms of Sale), which form an integral part of these terms.
Acceptable use
Use Orbily for lawful, personal study purposes. Do not resell, redistribute or offer the service to third parties as your own product.
You declare that you have the right to import and process the documents, photos and recordings you submit. Do not import content that is unlawful or that infringes others' rights.
Do not attempt to disrupt the service, bypass quotas or access controls, or extract data from other users.
Your content
You keep all rights to the content you import and generate. You grant us only the limited technical licence needed to process it in order to provide the features you request (including sending relevant excerpts to AI providers as described in the Privacy Policy).
Storage on your device
Important: your courses, documents, chats and study artifacts are primarily stored locally on your device. Orbily does not back them up on our servers.
Uninstalling the app, deleting its data, losing or replacing your device erases that content. Use "Export my data" regularly to keep your own copy. An expired subscription does not delete anything; you keep read access to your content.
AI-generated content
Study material, corrections and assistant replies are generated by AI models and may contain mistakes, approximations or omissions.
Always verify important information against your course materials and authoritative sources. Orbily is a study aid, not professional, medical, legal or academic advice, and a graded correction is an estimate, not an official mark.
Availability and changes
The service is provided "as is" and "as available", without warranty of uninterrupted availability. Generation quality depends on third-party AI providers.
We may suspend or limit the service for maintenance, security or abuse, and may terminate accounts that seriously breach these terms, after notice where practicable.
Liability
To the extent permitted by law, we are not liable for indirect damages, loss of data stored on your device, or losses caused by third-party providers.
Nothing in these terms excludes liability that cannot be excluded under applicable law, including liability towards consumers under mandatory French law.
Governing law and disputes
These terms are governed by French law. Before any court action, the parties will seek an amicable solution by writing to contact@orbily.net.
If you are a consumer, you benefit from the protective rules of your country of residence, including the possibility of using the European Online Dispute Resolution platform, and disputes may be brought before the courts of your home.
